General Terms and Conditions

§ 1 Scope

The following General Terms and Conditions (hereinafter referred to as „GTC“) apply between you and hearty things GmbH & Co. KG for the use of the app „fullfilled“ in its version valid at the time of registration or download. The „fullfilled“ app may only be used in accordance with these GTC. Deviating or contrary general terms and conditions will not become part of the contract, even if they are known, unless their validity is expressly agreed to in writing. In addition to these GTC, particularly with regard to registration and the contract conclusion process for in-app purchases, we rely on the services of independent third parties (hereinafter referred to as „Third Party Service“), such as the distribution platforms used to download the app, Apple App Store, and Google Play (hereinafter „App Store“). Third Party Services are not services of us/“fullfilled“ and may be subject to their own terms of use, which will be appropriately indicated. In case of contradictions, the general terms and conditions of the third-party provider prevail. The respective provider of the App Store is not a contracting party regarding the use of the fullfilled app.

§ 2 Provider of the App

The provider and contracting party for the use of „fullfilled“ is:

§ 3 Subject of the Contract

„fullfilled“ provides access to cooking recipes and content related to cooking and nutrition. This is not a legally binding offer, but an invitation to use the service or to order (invitatio ad offerendum). In addition, „fullfilled“ provides access to shopping lists and meal planners. All contents can be accessed via categories or search functions and partially displayed in a news feed. The shopping lists and meal planners are merely aids for the shopping process with external providers and are not offers in the legal sense. No contracts for the purchase of the products presented are concluded via „fullfilled“. The extent of the provision of contents and the possibilities of use (hereinafter referred to as „License“) are governed by the contract. This involves a paid subscription (see § 7). For activation, it is necessary to create a user account (cf. § 6). The simple license granted to you is limited in time to the duration of the account/paid subscription. We reserve the right to show you third-party advertising in the „fullfilled“ app. This may take the form of separate advertisements and/or advertorials as well as our own blog entries and guest contributions, within which products/services of third parties may be pointed out and linked. We reserve the right to adapt it at any time in a way that is reasonable for you, e.g., to further develop and improve the quality. This applies to both technical and content developments, such as free updates in the respective App Store, which change the functional scope of „fullfilled“. The exact system requirements and the complete owed functional scope of such updates and of the „fullfilled“ app in its current version result from the product and update description in the App Store. The rights to the contents on „fullfilled“ are exclusively owned by hearty things GmbH & Co. KG.

§ 4 Authorized Users

„fullfilled“ is exclusively aimed at consumers. Commercial use of „fullfilled“ is not permitted. The use of „fullfilled“ is solely for entertainment purposes. Only persons who have reached the age of 18 or persons who have completed their 16th year of life and whose legal representatives have consented to the use are entitled to use it. By using „fullfilled“ you assure your age of majority and legal capacity. In case of minority, you assure to have completed the 16th year of life and that the consent of your legal representative is given. We are entitled to make the use of „fullfilled“ dependent on suitable proof of your identity, your age of majority, or the consent of your legal representative. As soon as a minor user of „fullfilled“ continues to use beyond reaching the age of majority, all contracts concluded in connection with this account prior to reaching the age of majority are deemed to be approved, unless he objects to the approval within two weeks after reaching the age of majority.

§ 5 Download and Use

The use of „fullfilled“ requires the download and installation of the app from the App Store. The download of the app is free of charge. To download „fullfilled“, you need an account for the App Store. The contract for the use of „fullfilled“ and the services, including the granting of a personal, simple, unlimited, non-transferable license to „fullfilled“, is concluded when you click the „Install“ button (labeling may vary depending on the App Store), enter your password for the App Store if necessary, and accept the GTC
